1. Program Description
Eleven Solutions LLC operates an optional SMS/text messaging program for account notices, support follow-ups, billing reminders, security alerts, appointment confirmations, and other messages described at opt-in. The current program may use (888) 790-1911 or another number disclosed in the message or opt-in flow.
These SMS Terms apply to Eleven Solutions’ own messages to opted-in contacts. They do not replace Customer’s obligations for SMS or MMS campaigns sent through Customer’s Eleven Solutions account. Customer-operated campaigns remain governed by the Terms, Fair Use Policy, carrier rules, campaign registration, and Applicable Law.
2. Consent and Opt-In
You may opt in through a clearly identified unchecked SMS consent checkbox, keyword, written form, or another compliant method disclosed at enrollment. SMS consent is separate from acceptance of general Terms and is not a condition of purchasing services.
By opting in, you authorize Eleven Solutions to send recurring messages using automated technology to the number provided for the disclosed purposes. You represent that you are the subscriber or customary user of that number and are authorized to consent.
Consent is limited to Eleven Solutions and the disclosed program. Mobile opt-in data and consent will not be sold or shared with third parties or affiliates for their independent marketing or promotional purposes.
3. Message Types
Messages may include account activation, login or security alerts, service status, support updates, appointment reminders, billing notices, payment confirmations, policy notices, and limited service information consistent with the opt-in disclosure.
Marketing messages will be sent only where the opt-in clearly authorizes marketing. Transactional or security messages may be subject to different legal rules, but we will honor applicable opt-out rights and use reasonable channel separation.
4. Message Frequency
Message frequency varies based on account activity, support interactions, billing events, security events, and selected preferences. A typical participant may receive up to five messages per month, but active incidents, onboarding, verification, or support may produce additional messages.
Frequency statements are estimates and not contractual guarantees. We will not intentionally send messages unrelated to the disclosed program.
5. Charges and Carrier Conditions
Eleven Solutions does not charge a separate fee merely to receive its program messages, but message and data rates may apply under your wireless plan. Your carrier may impose roaming, messaging, or other charges.
Carriers and aggregators are not liable for delayed or undelivered messages. Delivery depends on coverage, handset status, number type, carrier filtering, network congestion, and other conditions outside our control.
6. STOP, HELP, and Revocation
You may revoke consent at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to the sending number. We may send one final confirmation. After processing, no further program messages will be sent unless you opt in again, except messages legally permitted despite an opt-out, such as certain security or service notices where another lawful basis exists.
Text HELP for support instructions or contact hello@elev1solutions.com. We will honor revocation through other reasonable methods where required by law. Opt-out processing may take a short operational period, but we will act within legally required timeframes.
Changing or transferring your mobile number does not automatically notify us. You must opt out before relinquishing a number and update your account so messages are not sent to a new subscriber.
7. TCPA, FCC, FTC, CTIA, and Carrier Compliance
The program is intended to comply with the TCPA, FCC rules, applicable Do Not Call provisions, the FTC Telemarketing Sales Rule where applicable, state telemarketing and privacy laws, CTIA Messaging Principles and Best Practices, carrier codes, toll-free verification, and other messaging requirements.
No clause in these SMS Terms waives non-waivable consumer rights. Legal requirements change and may differ by message type and jurisdiction. We may modify enrollment, frequency, content, sender numbers, or program operation to maintain compliance.
8. Privacy and Data Use
We process your number, consent record, opt-in source, timestamps, message content, delivery status, opt-out status, device or carrier information, and support interactions to operate, secure, document, and improve the program.
Information may be shared with messaging providers, carriers, aggregators, and vendors solely as necessary to deliver messages, process opt-outs, prevent fraud, and comply with law. See the Privacy Policy for additional details and rights.
9. Availability and Disclaimer
The SMS program is provided as-is and may be changed, suspended, or terminated at any time. We do not guarantee delivery time, uninterrupted availability, compatibility with every carrier or device, or receipt of time-sensitive information.
Do not rely on SMS as the sole channel for emergencies, 911, security-critical decisions, payment deadlines, or service continuity. Use the portal, email, telephone support, or emergency services as appropriate.
10. Contact
For SMS help, text HELP to the sending number, email hello@elev1solutions.com, or call +1 (888) 790-1911. Eleven Solutions’ corporate office line is +1 (833) 776-0111. Written correspondence may be sent to 1621 Central Ave #69526, Cheyenne, WY 82001.
11. Customer-Operated Messaging Programs
Customers using Eleven Solutions to send messages must create their own legally sufficient terms, privacy notices, opt-in disclosures, sample messages, frequency disclosures, rate disclosures, HELP response, STOP response, and support contact. Eleven Solutions’ corporate SMS Terms cannot be copied as a substitute unless the Customer’s facts, brand, numbers, purposes, vendors, and legal obligations are accurately reflected.
Customer must register brands and campaigns where required, keep registration current, and send only content consistent with the approved use case. Shared consent, third-party lead generation, affiliate marketing, loan, insurance, debt, financial, political, charitable, and other sensitive campaigns may face enhanced restrictions or rejection. Registration does not prove TCPA consent or legal compliance.
Customer must monitor delivery, opt-outs, complaints, carrier errors, and content. High opt-out or complaint rates, prohibited links, URL shorteners, deceptive content, snowshoe messaging, number rotation, or attempts to evade filtering can result in immediate suspension.
12. Consent Records and Audit Evidence
For each recipient, the sender should retain the exact opt-in disclosure, brand, purpose, telephone number, timestamp, source page or keyword, IP address or equivalent evidence, confirmation steps, message history, opt-outs, and any renewed consent. Screenshots without timestamped linkage to the recipient may be insufficient.
Consent records must be preserved for the period required by applicable law, litigation risk, carrier rules, and campaign agreements. Eleven Solutions may request records on short notice after a complaint or carrier inquiry. Failure to produce reliable records may result in blocking even if Customer believes consent existed.
Consent cannot be transferred freely between unrelated sellers, brands, products, or campaigns. A corporate acquisition, affiliate relationship, data purchase, or vendor contract does not automatically preserve valid consent. Customer must obtain legal advice for material changes.
13. Content and Link Restrictions
Messages must accurately identify the sender and must not contain fraud, phishing, malware, unlawful products, deceptive urgency, impersonation, prohibited financial schemes, illegal controlled substances, exploitation, hate, harassment, or content restricted by carriers. Customer must ensure links resolve to domains associated with the verified brand and must protect landing pages against compromise.
URL shorteners, shared public domains, redirect chains, phone-number obfuscation, unusual character substitution, and content designed to defeat filters may be restricted. Customer must not split a prohibited message across multiple texts or use MMS, images, or attachments to hide content.
Eleven Solutions and carriers may scan metadata or content where legally permitted for security, routing, abuse prevention, and compliance. Filtering can produce false positives, and no delivery guarantee is made.
