1. Purpose and Enforcement Standard
This Fair Use Policy protects consumers, emergency systems, numbering resources, carriers, upstream providers, communications networks, and Eleven Solutions from illegal, deceptive, abusive, fraudulent, unsafe, or technically harmful traffic. It applies to every account, user, endpoint, integration, reseller, downstream customer, call, message, recording, route, number, and campaign.
Compliance is measured by the substance, pattern, risk, and effect of activity, not merely by labels selected during signup. Eleven Solutions may act on verified violations, credible complaints, carrier analytics, traceback notices, abnormal patterns, regulatory requests, suspected compromise, or reasonable risk indicators. The prohibited examples are non-exhaustive.
No volume allowance is a safe harbor. Low-volume traffic may be prohibited, while high-volume traffic requires documented lawful consent, appropriate registration, prior approval where requested, and operational controls.
2. Lawful and Authorized Business Use
Services may be used for transparent business communications such as internal collaboration, customer support, transactional notifications, appointment reminders, authenticated account alerts, and lawful sales communications supported by valid consent. Customer must accurately describe its business, traffic, campaign, lead source, caller identity, and intended recipients.
Customer must obtain all licenses, registrations, consents, approvals, bonds, and permissions required by federal, state, local, tribal, foreign, carrier, and industry rules. Customer must be able to produce records proving compliance on request.
3. Prohibited Activities
The following conduct is prohibited whether performed manually, automatically, directly, through an agent, through a reseller, by API, by dialer, or through a downstream customer:
- Fraud, scams, phishing, smishing, vishing, impersonation, identity theft, social engineering, deceptive lead generation, fake support, fake government outreach, or attempts to obtain credentials, funds, medical data, financial data, or personal information through deception.
- Illegal robocalling, artificial-voice calling, prerecorded telemarketing, predictive dialing, power dialing, ringless voicemail, bulk messaging, or automated outreach without all legally required consent and approvals.
- Caller ID spoofing, ANI manipulation, false CNAM, number rotation to avoid blocking, neighbor spoofing, brand impersonation, use of numbers without authority, or falsification of traffic origin.
- Calls or messages to persons who opted out, revoked consent, requested do-not-call treatment, appear on applicable suppression lists, or are outside permitted calling hours.
- Harassment, threats, intimidation, hate speech, stalking, extortion, blackmail, obscene content, repeated unwanted contact, or communications intended to annoy, abuse, or frighten.
- Traffic pumping, access stimulation, artificial minute generation, short-duration fraud, looping, conference abuse, revenue-share exploitation, toll fraud, bypass, gray routing, SIM-box activity, or manipulation of carrier compensation.
- Credential sharing, compromised accounts, stolen cards, fake businesses, account farming, number farming, unauthorized resale, unapproved wholesale activity, or attempts to evade KYC, KYB, sanctions, fraud, rate, or concurrency controls.
- Emergency-service misuse, swatting, false emergency reports, interference with 911, testing emergency numbers without authorization, or concealment of dispatchable location.
- Illegal gambling, unlawful debt collection, trafficking, exploitation, controlled-substance activity, weapons trafficking, sanctions evasion, money laundering, or other criminal conduct.
- Malware delivery, denial-of-service activity, scanning, brute-force attempts, unauthorized interception, credential harvesting, security testing without written permission, or interference with platform operation.
4. Restricted and High-Risk Campaigns
Eleven Solutions may require prior written approval, enhanced KYC, legal review, scripts, templates, proof of consent, lead-source evidence, registration, deposits, higher rates, dedicated numbers, monitoring, or additional contractual terms for high-risk campaigns. Approval may be withheld or revoked at any time.
Restricted categories include final-expense insurance, Medicare or health insurance, pharmacy, debt relief, credit repair, tax relief, loans, mortgage relief, warranties, solar, utility switching, investment, cryptocurrency, forex, sweepstakes, prizes, political outreach, fundraising, charitable solicitations, surveys, lead generation, appointment setting, adult-oriented services, and any category with elevated complaint or enforcement risk.
Approval is limited to the exact business, script, brand, lead source, consent flow, number set, destination, volume, and use case reviewed. Material changes require renewed approval.
5. Consent, Suppression, and Calling Hours
Customer must collect and retain legally sufficient consent before contacting recipients. Consent must be clear, conspicuous, unambiguous, specific to the named seller and channel, and supported by records showing the disclosure, timestamp, source, number, IP address or equivalent evidence, and revocation status.
Customer must maintain internal do-not-call and suppression lists, scrub against the National Do Not Call Registry and applicable state registries, honor STOP and equivalent opt-out commands, process revocations through reasonable channels, and prevent re-contact unless lawful renewed consent is obtained.
Customer must comply with federal and state calling-hour restrictions based on the recipient’s local time and any stricter campaign or carrier rule. Dialers must be configured to prevent abandoned-call, dead-air, excessive retry, and harassment patterns.
6. Identity, Branding, and Number Reputation
Every caller ID, sender ID, CNAM, brand, domain, short code, toll-free number, local number, and campaign identity must be truthful, authorized, and traceable to the verified Customer. Customer may not present a misleading local presence or disguise the commercial nature or source of a communication.
Customer must not rotate numbers to evade spam labels, analytics, complaints, consent rules, or blocking. Numbers may not be treated as disposable identities. Eleven Solutions may quarantine or replace numbers, reduce attestation, restrict outbound identity, or require remediation when reputation degrades.
Spam labels and carrier blocking are controlled by independent analytics and carriers. Eleven Solutions does not guarantee label removal or call completion and may require Customer to change calling practices before supporting remediation.
7. SMS, MMS, A2P 10DLC, and Carrier Rules
Customer may send application-to-person messages only through properly registered and approved campaigns where registration is required. Brand and campaign information must remain accurate. Templates, opt-in flows, opt-out language, help responses, content, throughput, and number use must match the approved campaign.
Customer must include required sender identification and opt-out instructions, honor STOP and HELP functionality, avoid prohibited content, maintain consent records, and comply with CTIA, carrier, aggregator, toll-free verification, short-code, and campaign registry requirements.
Carrier filtering, surcharges, throughput limits, registration rejection, campaign suspension, and message blocking may occur without advance notice. Customer is responsible for fees and penalties caused by inaccurate registration, prohibited traffic, or noncompliance.
8. Network Integrity and Technical Restrictions
Customer must not exceed purchased concurrency, generate abnormal call bursts, maintain artificial open calls, loop calls, cause excessive retries, send malformed SIP signaling, manipulate answer supervision, misuse codecs, originate unauthorized destinations, or interfere with routing, billing, security, or monitoring.
Eleven Solutions may set dynamic limits based on risk, destination, traffic pattern, answer-seizure ratio, average call duration, complaint rate, short-call ratio, registration behavior, IP reputation, payment history, and carrier requirements. Published or purchased limits are maximum technical ceilings, not unconditional usage rights.
Customer must promptly patch systems, secure credentials, restrict IP access, disable unnecessary international routes, and investigate anomalies. Suspected compromise must be reported immediately.
9. Monitoring Signals and Review
Eleven Solutions may analyze signaling, metadata, CDRs, message status, content where legally permitted, complaint data, traceback reports, number reputation, payment risk, authentication events, IP behavior, campaign registration, and other telemetry to protect the service and comply with law.
Risk signals include abnormal answer rates, excessive short calls, repeated retries, high abandonment, rapid number rotation, geographic inconsistencies, unusual concurrency, high opt-out rates, undelivered messages, invalid caller ID, traffic inconsistent with stated use, or sudden changes in volume.
Monitoring does not create a duty to detect every violation. Customer remains solely responsible for its activity even if Eleven Solutions does not identify or stop it immediately.
10. Investigations, Records, and Cooperation
Customer must respond to compliance inquiries within the deadline specified, which may be immediate for active harm. Required material may include scripts, recordings, consent records, lead forms, suppression logs, customer contracts, invoices, campaign registration, identity documents, call samples, CDRs, routing details, and proof of number authority.
Eleven Solutions may preserve records, share relevant information with carriers, traceback organizations, regulators, courts, law enforcement, emergency services, payment processors, and affected providers where permitted or required, and may take protective action before an investigation concludes.
Failure to cooperate, delayed responses, false records, altered evidence, or inability to prove consent may independently justify suspension or termination.
11. Enforcement Measures
Eleven Solutions may warn, require remediation, impose limits, block destinations, disable messaging, reduce concurrency, quarantine numbers, withhold attestation, suspend features, increase deposits, surcharge traffic, require prepayment, terminate routes, or close accounts. Measures may be applied without notice when rapid action is needed.
Eleven Solutions may terminate any connection or account at any time without providing a reason. A policy violation makes the Customer ineligible for refunds or credits except where a non-waivable law requires otherwise.
Customer is responsible for carrier penalties, traceback costs, regulatory fines, legal expenses, investigation costs, and remediation expenses caused by Customer activity, subject to Applicable Law and the Terms.
12. Reporting Abuse and Safe Disclosure
Abuse reports should identify the calling or messaging number, date, time, content, recipient, screenshots or recordings, and any other available evidence. Reports may be submitted to hello@elev1solutions.com or by mail to 1621 Central Ave #69526, Cheyenne, WY 82001.
Good-faith security reports must not involve privacy violations, service disruption, social engineering, data destruction, or access beyond what is necessary to demonstrate a vulnerability. Testing production systems without written authorization is prohibited.
13. Minimum Campaign-Control Requirements
Before production launch, every outbound campaign must have a documented owner, verified business identity, approved caller IDs, written purpose, audience definition, lawful basis, consent source, suppression process, calling-hour logic, retry policy, abandonment controls, complaint process, and retention plan. Customer must test configuration with controlled recipients and must not use live consumers as an unreviewed test population. Dialer settings must be conservative enough to prevent dead air, repeated nuisance calls, excessive simultaneous attempts, and calls that continue after opt-out.
Customer must maintain change control for scripts, message templates, lead vendors, consent language, domains, numbers, dialer software, routing, and campaign categories. Material changes require legal and operational review. A campaign approved for transactional reminders cannot be converted into marketing; a campaign approved for one seller cannot be used for affiliates; and consent for one product does not automatically authorize unrelated products.
Campaign records must be organized so Eleven Solutions can evaluate a complaint rapidly. Records should identify the seller, caller, number, recipient, time zone, lead source, consent disclosure, timestamp, revocation status, script version, agent, recording where lawful, and disposition. Inability to reconstruct why a recipient was contacted may be treated as a control failure.
14. Lead Vendors, Affiliates, and Third-Party Data
Customer is responsible for every lead source, affiliate, publisher, list broker, comparison site, form builder, call center, and marketing partner used in connection with the services. Customer may not rely on a vendor’s generic certification. Customer must independently review the actual consumer-facing disclosure, capture method, seller identification, timestamping, audit trail, transfer restrictions, and revocation handling.
Purchased, aged, recycled, co-registered, scraped, appended, inferred, or publicly available contact data is high risk and may be prohibited even when a vendor labels it “compliant.” Customer must verify that the person expressly agreed to communications from the specific seller using the specific channel and technology. Evidence that merely shows a consumer visited a website, requested information from an industry, or accepted broad partner language may be insufficient.
Customer must contractually require vendors to preserve evidence, honor suppression, restrict resale, notify of complaints, permit audit, and indemnify Customer. Eleven Solutions may require Customer to stop using a vendor immediately and may share abuse findings with carriers, registries, or regulators where permitted.
15. Agent and Call-Center Conduct
Customer must train and supervise agents regarding identity disclosure, truthfulness, consent, do-not-call requests, complaint escalation, payment authorization, sensitive information, recording notices, and prohibited claims. Agents may not misstate affiliation, create false urgency, threaten consequences, conceal pricing, misrepresent eligibility, continue after a clear refusal, or obstruct an opt-out.
Customer must use quality assurance appropriate to campaign risk, which may include call monitoring where lawful, script controls, disposition review, complaint sampling, conversion anomaly detection, and discipline. Compensation structures must not encourage fraud, unauthorized billing, suppression evasion, or concealment of complaints. Customer remains responsible for remote agents, contractors, offshore call centers, and subcontractors.
Eleven Solutions may require removal of an agent, manager, dialer, script, or location associated with abuse. Repeated complaints involving the same personnel, lead source, script, or sales practice may justify termination of the entire account even if Customer claims the conduct was unauthorized.
16. Quality Metrics Are Risk Signals, Not Guaranteed Thresholds
Eleven Solutions may evaluate answer-seizure ratio, call completion ratio, post-dial delay, short-duration percentage, average duration, abandoned-call rate, repeat attempts, unique destination ratio, complaint ratio, opt-out rate, delivery failure, spam labeling, attestation distribution, country mix, concurrent sessions, and traffic bursts. Metrics may be evaluated by account, user, campaign, number, IP address, reseller, destination, carrier, or time interval.
No single metric proves compliance or violation. Legitimate campaigns can have unusual metrics, and unlawful campaigns can appear normal. Eleven Solutions may combine telemetry with complaint content, business model, script, lead source, payment risk, identity, traffic history, and external intelligence. Customer may be required to explain anomalies and produce supporting evidence.
Eleven Solutions may change thresholds dynamically and need not publish anti-fraud logic. Disclosing exact thresholds could facilitate evasion. Customer has no right to operate up to a hidden threshold, and deliberate shaping of traffic to remain just below controls is a violation.
17. Remediation Plans and Reinstatement
Where Eleven Solutions permits remediation rather than immediate termination, Customer must submit a written plan identifying root cause, affected traffic, corrective actions, owners, dates, validation, and prevention. Generic assurances are insufficient. Eleven Solutions may require new consent, lead-source termination, retraining, dialer reconfiguration, number replacement, lower concurrency, restricted destinations, prepayment, or independent legal review.
Reinstatement is discretionary and may be limited to a monitored pilot. Eleven Solutions may require clean traffic for a specified period before restoring features or volume. A prior reinstatement does not require future reinstatement, and repeated failures may result in permanent termination.
Customer must not migrate prohibited traffic to another Eleven Solutions account, reseller, affiliate, number range, IP address, or identity. Evasion after enforcement is an independent material breach and may result in broad blocking of related entities and credentials.
