International Outbound Calling Compliance: US, UK, Australia, and Canada
Multinational outbound calling operations that extend across the US, UK, Australia, and Canada face a compliance challenge that is often underestimated: each jurisdiction has an independent regulatory framework with different definitions of consent, different calling hour restrictions, different do-not-call registry requirements, and different enforcement mechanisms. A campaign that is fully compliant in the US may violate the UK's Privacy and Electronic Communications Regulations, Australia's Spam Act, or Canada's Anti-Spam Legislation (CASL) simultaneously.
United States: TCPA and TSR Framework
The US framework for outbound calling compliance is governed primarily by the Telephone Consumer Protection Act (TCPA) enforced by the FCC, and the Telemarketing Sales Rule (TSR) enforced by the FTC. Key requirements include prior express written consent for auto-dialed marketing calls, national DNC registry scrubbing within 31 days, call time restrictions (8am–9pm local time of the called party), and a 3% maximum abandoned call rate per campaign per day. State-level mini-TCPAs in Florida, Illinois, Washington, and others impose additional or broader requirements.
United Kingdom: PECR and ICO Enforcement
- PECR consent standard: The UK's Privacy and Electronic Communications Regulations require opt-in consent for unsolicited marketing calls using automated dialing systems. The UK Telephone Preference Service (TPS) must be scrubbed before calling residential numbers—non-compliance carries ICO fines up to £500,000.
- Live agent calls: Calling TPS-registered numbers with live agents is permitted if the organization has a prior business relationship with the recipient, but the definition of "prior relationship" is narrow and strictly enforced.
- Calling hour restrictions: No specific statutory calling hours in the UK, but the ICO considers calls before 8am or after 9pm to be evidence of intent to harass and treats them as regulatory aggravating factors in enforcement decisions.
Australia: Do Not Call Register Act and ACMA
- Australia's Do Not Call Register Act 2006 prohibits telemarketing calls to numbers listed on the DNCR operated by the ACMA. Unlike the US, charity, political, religious, and educational organizations are exempt from DNCR scrubbing requirements.
- Calling hours in Australia: residential numbers may only be contacted Monday to Friday 9am–8pm local time, Saturday 9am–5pm local time. Calls to residential numbers on Sundays or public holidays are prohibited regardless of DNCR status.
- The ACMA can issue infringement notices of up to AUD 250,200 per contravention for individual violations and has pursued enforcement against both domestic and international-origin call campaigns targeting Australian numbers.
Canada Compliance
"Canada's CASL and National DNCL operate independently—you must comply with both for marketing calls."
Canada's Anti-Spam Legislation (CASL) governs electronic marketing messages broadly, while the National Do Not Call List (DNCL) governed by the CRTC specifically covers telemarketing calls. Canadian telemarketing requires DNCL scrubbing, calling hour restrictions (local time of the called party: 9am–9:30pm weekdays, 10am–6pm Saturdays, and no calls on Sundays or national holidays), and a 24-hour minimum identification disclosure period for caller ID. CASL's implied consent provisions differ from TCPA consent standards—do not assume US consent documentation satisfies CASL requirements.
